Job SummaryThe Privacy and Regulatory Analyst position requires: strong critical thinking, research and analytical skills; a thorough understanding of the privacy and security arena; ability to independently assess and investigate privacy incidents; proven experience comprehending, explaining and applying regulatory concepts to business situations; ability to review state reporting requirements and to timely complete state reports; ability to effectively communicate with regulators; strong communication and presentation skills to consult with and educate staff members at all levels of the company on privacy-related topics; proactive contribution of, and execution on, new ideas to improve the strategic direction of the Privacy Office, and a high degree of organizational skills and initiative in order to support the Privacy Office.
Under the supervision of Luminare Health's Assistant General Counsel, this position will:
  • Coordinate and operate the process for receiving, documenting, tracking, investigating, and storing information concerning privacy incidents. This includes, but is not limited to:
  • Serve as the primary privacy contact within the Privacy Office for incident reporting.
  • Fully assess and investigate the incident and evaluate all pertinent information.
  • Work with Luminare Health attorneys to determine whether the incident constitutes a breach, notification requirements and regulatory reporting requirements.
  • Compose appropriate correspondence to clients, impacted individuals, and regulators.
  • Document all actions and correspondence in the appropriate systems.
  • Provide appropriate reporting to regulators and well as internal interested parties.
  • Proactively identify workflow improvements that result in less risk and better customer satisfaction.
  • Assist in the development and maintenance of privacy policies and procedures with the Business Units throughout the Enterprise and collaborate with the Business Units on enterprise-wide objectives related to privacy matters. Proactively identify and offer suggestions for process improvements to the Business Units.
  • Serve as the primary privacy contact within the Privacy Office for inquiries and respond to and resolve inquiries from the Business Units and customers related to privacy issues.
  • Assist Luminare Health's Assistant General Counsel in summarizing applicable federal and state regulatory guidance on privacy and security requirements, including statutes, regulations, bulletins, and official guidance and identifying impact of same on Luminare Health. This may also include:
    • Engage with appropriate areas on assigned tasks and oversee status to completion, and report to the Privacy Office on status. This requires developing collaborative relationships to effectively provide consultation to business units and the Privacy Office on the implications of legislation and regulations.
    • Help identify and report new trends in legislation /regulation and identify opportunities to increase efficiency and establish a more uniform approach across Luminare Health.
  • Assist in collecting data and filing periodic reports with governmental agencies, including:
    • Proactively managing calendar of due dates for reports.
    • Communicating necessary data requirements to business with sufficient lead-time to meet state regulatory reporting requirements.
    • Communicating status on open reporting to management.
    • Evaluating reasonableness of data and submit to regulatory entities.
    • Completing and maintaining documentation of annual reporting processes.
    • Develop collaborative relationships with business and regulators.
Minimum Requirements
  • Bachelor's degree required.3+years of experience analyzing laws/regulations, preferably in a healthcare work setting
  • Experience working with privacy and security related matters and reporting on incidents.
  • Proven research and analytical skills. Knows how to use resources and seeks out new sources ofinformation.
  • Proven ability to quickly understand key business drivers, products and processes.
  • Proven ability to build relationships and foster a collaborative atmosphere.
  • Independence, initiative and knowledge to work with minimal supervision.
  • Proven ability to be proactive in researching and obtaining critical information.
  • Exceptional verbal and written communication skills.
  • Ability to learn quickly while operating in a self-directed environment.
Preferred
  • Paralegal training or certificate or working in an in-house legal department a plus
  • Familiarity with various privacy frameworks including but not limited to HIPAA, CCPA and GDPR
  • Experience drafting policies, procedures, standards and controls
  • Insurance industry experience preferred
  • Westlaw or Lexis-Nexis experience preferred

The compensation offered will vary depending on your job-related skills, education, knowledge, and experience. This role aligns with an annual incentive bonus plansubject to the terms and the conditions of the plan.

Min to Max Range:

$56,700.00 - $106,400.00
